- Primero. DEJAR SIN EFECTO el auto de 2 de febrero de 2009 proferido la Sala Penal del Tribunal Superior del Distrito Judicial de Cali, dentro del tramite constitucional de la referencia.
- Segundo. ORDENAR a la Sala Penal del Tribunal Superior del Distrito Judicial de Cali, que sin mas dilaciones, se pronuncie de fondo sobre la impugnacion formulada por el senor Cesar Amu Mosquera contra el fallo de tutela dictado por el Juzgado 18 Penal del Circuito de Cali.
- Tercero. Por Secretaria General, comuniquese al Juzgado 5o Penal del Circuito de Popayan y al Juzgado 18 Penal del Circuito de Cali, la decision adoptada para los fines expuestos en esta providencia.
